It's part of a culture of lawsuits, it's not worth the time, and cost, for major corporations to fight these nuisance suits so he'll get a couple of grand just to go away .

That's not how the legal system works. Anyone can file any sort of suit for any reason they want. However, an attorney filing a frivolous lawsuit can be sanctioned under Rule 11 for attempting to pursue a claim without colorable merit. Fees and costs may be imposed on the person submitting the claim if it's found to be frivolous. This issue would certainly be resolved on summary judgment, assuming there are no other facts that aren't mentioned in the article.

As an actuarial fact many "nuisance" suits are simply settled to avoid litigation costs, and that is how the legal system really works .

Since "colorable merit" is a subjective interpretation from the bench and since sanctions under Rule 11 may only be granted after notice and a reasonable opportunity to respond proceedings will have generally already reached a point whereby the accused will already have committed financial resources to the case prior to any Rule 11 decision.As an actuarial fact many "nuisance" suits are simply settled to avoid litigation costs, and that is how the legal system really works .
